Welcome to Gampine AI Automation & Analytics (“Gampine,” “Company,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our websites, products, software, automation systems, AI tools, and services, including SmartBizNow-branded services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

By accessing, purchasing, or using any Gampine or SmartBizNow Services, you acknowledge that you have read, understood, and agreed to these Terms. These Terms apply to all users, customers, subscribers, and visitors.

Gampine AI Automation & Analytics provides AI-powered business solutions, including but not limited to:

  • AI-driven call handling and virtual front desk systems
  • AI chatbots and lead capture tools
  • Workflow and CRM automation
  • Business process automation
  • Analytics and reporting tools
  • Subscription-based software and services
  • SmartBizNow-branded AI products and automation services

Service features, availability, and pricing may change at any time.

 

  1. Eligibility & Account Responsibility

Eligibility

You must be at least 18 years old to use our Services.

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity conducted under your account
  • Ensuring accurate and up-to-date account information

We are not responsible for unauthorized access resulting from your failure to secure your credentials.

 

  1. Acceptable Use & Prohibited Activities

You agree not to use our Services to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading activities
  • Transmit malware, spam, or malicious code
  • Interfere with the integrity or performance of our systems
  • Misuse AI systems in a harmful, illegal, or unethical manner

We reserve the right to suspend or terminate access for violations.

 

  1. AI & Automation Disclaimer

You acknowledge and agree that:

  • AI systems are probabilistic and may produce inaccurate, incomplete, or unexpected outputs
  • AI-generated responses are not guaranteed to be correct, compliant, or appropriate
  • AI tools should not be relied upon for legal, medical, financial, or regulatory advice

You are solely responsible for reviewing, monitoring, and approving AI outputs before use.

 

  1. No Guarantee of Results

Gampine and SmartBizNow do not guarantee:

  • Increased revenue or conversions
  • Lead quality or response rates
  • Business outcomes or performance improvements
  • Continuous availability of third-party services

Results depend on factors beyond our control, including traffic, industry, messaging, customer behavior, and external platforms.

 

  1. Third-Party Services & Dependencies

Our Services rely on third-party platforms, including but not limited to:

  • Telecommunication carriers
  • SMS and voice providers
  • AI model providers
  • Hosting, CRM, and automation platforms
  • Payment processors (e.g., Stripe)

We are not liable for outages, delays, failures, or disruptions caused by third parties.

 

  1. Customer Compliance Responsibilities

You are solely responsible for compliance with all applicable laws, including but not limited to:

  • TCPA (Telephone Consumer Protection Act)
  • Call recording and consent laws
  • CAN-SPAM, GDPR, and data privacy regulations

Gampine does not provide legal compliance advice. You are responsible for obtaining all required consents and disclosures.

 

  1. Payment, Billing & Subscriptions
  • Fees are due as specified at purchase or in your service agreement
  • Subscription fees are billed in advance on a recurring basis
  • Payments are processed via third-party payment processors
  • Failure to pay may result in suspension or termination

All setup fees are non-refundable unless explicitly stated otherwise.

 

  1. Cancellations & Refunds

Unless otherwise stated in writing:

  • You may cancel subscriptions at any time to stop future billing
  • No refunds are issued for partial billing periods
  • Usage-based charges already incurred remain payable

 

  1. Intellectual Property

All content, software, workflows, prompts, automation logic, and materials provided by Gampine or SmartBizNow are proprietary and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services. You may not copy, resell, reverse engineer, or redistribute any part of the Services without written permission.

 

  1. Confidentiality

Both parties agree to maintain the confidentiality of non-public information obtained during the course of the relationship, except where disclosure is required by law or permitted in writing.

 

  1. Disclaimer of Warranties

The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

 

  1. Limitation of Liability

To the maximum extent permitted by law:

  • Gampine shall not be liable for indirect, incidental, special, or consequential damages
  • Total liability shall not exceed the amount paid by you in the 30 days preceding the claim

 

  1. Indemnification

You agree to indemnify and hold harmless Gampine AI Automation & Analytics from any claims, damages, losses, or expenses arising from:

  • Your use of the Services
  • Your customer communications
  • Your failure to comply with applicable laws

 

  1. Termination

We reserve the right to suspend or terminate access to the Services at our discretion, with or without notice, for violations of these Terms or conduct harmful to our business or systems.

 

  1. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Collier County, Florida.

 

  1. Changes to These Terms

We may update these Terms at any time. Changes are effective immediately upon posting. Continued use of the Services constitutes acceptance of the revised Terms.
